The investments will be mainly in US Dollars, while there could be other investments in other currencies. Currency risks arise when payment is made to purchase units in a currency other than US dollars. High volatility and/or lack of adequate active liquid markets for a security/ETF may prevent a Client from selling his / her securities/ETFs entirely or partially or at a particular time or at a particular price because Boubyan Capital may have difficulty liquidating the same or may be forced to sell at a significant discount to market value. While Boubyan Capital shall ensure that the securities/ETFs held in the Client's accounts are based on reasonably available exchange traded security data, Boubyan Capital may from time to time receive or use inaccurate data which could adversely affect securities/ ETFs valuations, liquidity and the resulting fees paid by the Client to Boubyan Capital.
The value of the investments may be negatively or positively affected due to the change of the central banks’ discount rates which may affect the economic conditions in general and sukuk market performance in particular, and this, in turn, may impact the value of securities or the funds.
Clients should be aware that adverse economic consequences may result in impaired credit rating, default, bankruptcy or insolvency any of which may affect portfolio values or its management and that such risk is beyond the control of Boubyan Capital. This risk applies to assets held with any broker utilized by Boubyan Capital notwithstanding segregation of assets and insurance requirements that would in most cases apply to the benefit of the Client. In addition, exchange trading venues or trade settlement and clearing intermediaries could experience adverse events that may temporarily or permanently limit trading or adversely affect the value of Client’s securities. Finally, any issuer of securities may experience a credit event that could impair or erase the value of the issuer’s securities held by a Client.
Unlike others, some sectors in the capital markets may be affected adversely or positively and this may affect the performance of the Fund, due to the volume of investments in this sector.
Changes in the regulatory or legal framework (including taxes) may affect the potential profitability or the legality of the investments (this risk is even bigger in emerging markets). One’s rights against the defaulting counterparty may be limited to contractual remedying against the counterparty as per the conditions of the relevant security. Clients may face difficulties in following in the path of the legal remedying or in obtaining and enforcing judgments against this party, especially if the case is filed before foreign courts or if the party is domiciled abroad.
The available investments are Sharia compliant, hence, these risks arise when one of the investments is not complying with some Sharia controls. The client may sustain losses in case of having to dispose of such investments at a low price or in case of missing any performance opportunity which could be higher than such investments.

ETF performance may not exactly match the performance of the index or market benchmark that the ETF is designed to track because 1) the ETF will incur expenses and transaction costs not incurred by any applicable index or market benchmark; 2) certain securities comprising the index or market benchmark tracked by the ETF may, from time to time, temporarily be unavailable; and 3) supply and demand in the market for either the ETF and/or for the securities held by the ETF may cause the ETF shares to trade at a premium or discount to the actual net asset value of the securities owned by the ETF.
